Terms and conditions

As part of Lloyds TSB Bank plc’s (the “Bank”, “we”, “us” or “our”) partnership with the London 2012 Olympic and Paralympic Games, we are running a number of different campaigns through a number of our group brands.

This campaign offers the public the opportunity to participate in the London 2012 Paralympic Torch Relay (the “Relay”).   The Relay is scheduled to take place between 24 August and 28 August 2012. There are 40 slots in the Relay available across the differently branded campaigns set out below.

40 slots (in aggregate) are available through Lloyds TSB and Bank of Scotland branded campaigns.

In addition to this campaign, there may be further opportunities to secure a place in the Relay through other Lloyds Banking Group London 2012 campaigns.

The Specific Terms and Conditions in Parts A to G, together with the General Terms and Conditions at Part H, apply to the Lloyds TSB Carry the Paralympic Flame London 2012 campaign.  Members of the public may be nominated or may nominate themselves for a chance to carry the Flame in/participate in one of 40 slots in the Relay directly through us or Bank of Scotland.

Bank Torchbearer” means a Nominee who has been selected as part of this campaign to participate in the Relay, subject to meeting the criteria set out by “LOCOG”

LOCOG” means London Organising Committee of the Olympic and Paralympic Games Limited, the company responsible for the delivery of the London 2012 Olympic and Paralympic Games.

Nominator” means the person nominating an individual to participate in the Relay.

Nominee” means the person being nominated.

Making a Nomination or Being Nominated to Carry the Paralympic Flame

Part A. General

1)     Participation in the Relay is subject to the Torchbearer meeting the criteria set out by LOCOG. We are not responsible for any unforeseen circumstances or decisions made by LOCOG that may affect torchbearer participation including changes to the Relay route, location, time and date.

2)     Nominators and Nominees must be resident in, and have a registered address in, the United Kingdom (including the Channel Islands and Isle of Man).  Members of HM Armed Forces based overseas may be a Nominator and/or a Nominee provided an address within the United Kingdom (including the Channel Islands and Isle of Man) is submitted. We suggest this is a close friend or family member’s home address.

3)     Nominators can make multiple nominations. Where a Nominee is nominated more than once (whether directly through us or through Bank of Scotland), only the first nomination accepted by the Nominee will be considered for a slot in the Relay.

4)     Torchbearers will only be permitted to carry the Paralympic Flame once during the Relay.

5)     Nominations can be made from 00.01 hrs on 18 October 2011 to 17.59.59 hrs on 22 November 2011 either by post (as outlined below), by telephone (by calling 0208 4958301)  or by going online to  www.lloydstsb.com/paralympicflame.

6)     Individuals aged 12 years or over can nominate themselves or other people who are also aged 12 years or over at the time of the nomination for a slot in the Relay. Proof of date of birth will be required if a Nominee is selected to be a Bank Torchbearer.

7)     To make a nomination the Nominator must describe in 150 words or fewer how the Nominee has inspired and supported people with a disability in their community (the “Entry Question”). Factors the judging panel will take into account are outlined at Part D below

8)     Nominators and Nominees under 18 years of age at the time of the nomination will require the consent of their parent or guardian to make or accept the nomination (as applicable) in accordance with our and LOCOG’s requirements.  In such circumstances we will ask a Nominee’s parent or guardian for their consent before we include the Nominee in the campaign and before any of the information provided as part of the nomination process (including details of the Entry Question) is published on our Carry the Paralympic Flame website.

9)     Nominees must review, edit if appropriate and accept their nomination before it will be entered into the campaign. If an online nomination is not accepted by the Nominee (and if necessary their parent or guardian) by 17.59.59 hrs on 22 November 2011 the nomination will not be entered into the campaign.  Where a Nominee accepts their nomination by post (including if necessary their parents’ or guardian’s consent) this must be post marked on or before 22 November 2011 in order to be entered into the campaign.

10)  We will not be responsible for any initial nominations and/or accepted nominations which are not received by the closing date.

11)  Nominees (or if under the age of 18, their parent or guardian) may reject a nomination if they do not want to take part.

12)  When a nomination has been approved and accepted by a Nominee (and if necessary, their parent or guardian) information relating to both the Nominator and Nominee which is provided as part of the nomination process (including names, age ranges, counties, stories, photographs and/or videos) may be published on our website and used for any other purpose we consider appropriate to publicise activities relating to our sponsorship of the Relay. LOCOG may contact Nominators and Nominees for the purpose of organising the Relay and also use information such as name, image, story and town for its own publicity purposes.  By accepting a nomination, Nominees (and if necessary, their parent or guardian) agree to the additional requirements LOCOG has of Torchbearers. These will be notified by LOCOG or us to successful Nominees.

13)  By entering this campaign, all Nominators and Nominees consent to promotion and publicity of their name, town, image and story by Lloyds Banking Group and LOCOG..

14)  By entering this campaign Nominators and Nominees agree to be filmed, televised, photographed and/or otherwise recorded in connection with the Relay, and to make themselves available for media and publicity interviews and photographs if required for the purposes of publicising and promoting the Relay at a convenient time and place. Nominators and Nominees agree that LOCOG, the International Olympic Committee, International Paralympic Committee and selected third parties (including the commercial and media partners of the Relay, the London 2012 Games and future Olympic and Paralympic Games) shall be permitted to use such films, photographs and recordings and their image and likeness for the purpose of promoting and publicising the Relay, the London 2012 Games, future Olympic and Paralympic Games and the Olympic and/or Paralympic movements more generally.

15)  After a Nominee accepts their nomination the content of that nomination will be reviewed by us to ensure that it does not contain any offensive, inappropriate or otherwise unsuitable material before being put forward for judging.

16)  Both the Nominee and the Nominator will be notified by us by email or telephone, (where an email address is provided) as soon as reasonably possible after the Nominee accepts the nomination.  Once accepted a Nominee will not be able to make changes to their profile or contact details, so if a Nominee is anticipating a change in contact details a phone number, email address or postal address at which they can be reached in any event should be provided.

17)  Employees of any company within the Lloyds Banking Group (“Lloyds Banking Group Employees”) may make nominations for individuals who are not Lloyds Banking Group Employees. However, Lloyds Banking Group Employees are not eligible to be a Nominee and if nominated will be rejected from this campaign for an opportunity to be a Bank Torchbearer.  LOCOG employees are excluded from taking part in this campaign.

18)  All nominations must be made in English in order to be considered.

has inspired someone to do something they never thought possible

has encouraged others to work together to succeed

has used the values of courage, determination, inspiration and equality to make a difference

has pushed the boundaries of what is achievable and helped others to accomplish whatever they put their mind to

The Bank Panel will award Bank Torchbearer slots to Nominees whom they consider most deserving.

Part E.  Bank Torchbearer Notification

29)  All Nominees who are shortlisted or selected as Bank Torchbearers and who are under 18 years of age at the time of nomination will be required to submit a signed consent from their parent or guardian in order to participate in the Relay. The Nominees and their parents/guardians will be contacted by us during April 2012 and asked to return such consent at a specified address within 5 business days of receipt. We will use reasonable efforts to contact Nominees and their parents or guardians but if confirmation of consent is not received as stipulated, the Nominee will forfeit their Bank Torchbearer slot and an alternative participant will be selected.

30)  Nominees who are selected as Bank Torchbearers as part of this campaign will be notified by us by email, telephone or post in April 2012. Bank Torchbearers will begin receiving communications from LOCOG by email, telephone or post during April and May 2012 and will be required to provide additional information to LOCOG before their participation in the Relay is confirmed.

Each Bank Torchbearer will be solely responsible for travel to and from the venue and all other expenses associated with participation in the Relay. We assume no responsibility and are not liable for any costs, charges or expenses which may require payment in connection with Relay participation.

34)  Bank Torchbearers will be confirmed as official Torchbearers and will be contacted by LOCOG for all Relay participation details. LOCOG has the final decision on Bank Torchbearer participation and the location where each Bank Torchbearer will carry the Paralympic Flame. We are not responsible for any decisions made by LOCOG that may affect Bank Torchbearer participation (this includes changes to the Relay route, the participation details communicated to the Bank Torchbearer including time, day and location).

35)  Bank Torchbearers will be required to: (i) sign up to LOCOG’s terms of participation; (ii) consent to security and/or other background checks; and (iii) provide any other information required by LOCOG to organise the Relay.

7)     Any fraudulent, illegible, multiple or incorrectly completed entries, those that do not comply with the ‘how to enter’ instructions in the Specific Conditions and any received outside of the promotional period set out in the Specific Conditions will not be accepted.

8)     Specific Conditions will set out the means by which a London 2012 Competition can be entered.

9)     No purchase is necessary to enter into a London 2012 Competition.

Supplying Information to us

10)  We will use the information you supply to us here and during your participation in any London 2012 Competition to:

10.1 send you information and offers around our partnership with the London 2012 Olympic and Paralympic Games;

10.2 verify, where relevant, that you are a customer of Lloyds TSB Bank Plc or Lloyds TSB Scotland Plc or Bank of Scotland plc;

12)  This consent only relates to London 2012 Competitions. We will not use it to update any preferences you have already given us in respect of our other products and services.

13)  The Lloyds Banking Group includes us and a number of other companies using brands including Lloyds TSB, Halifax and Bank of Scotland, and their associated companies. More information on the Lloyds Banking Group companies, including Lloyds TSB Bank Plc and Lloyds TSB Scotland Plc, can be found at www.lloydsbankinggroup.com

15)  You confirm, where an entry contains the personal details of a third party, or material in which a third party has rights, that you have the consent from such third party to provide these details and grant us a licence, including the right to create a royalty free sub licence, in the content of your entry.

(Intellectual Property Rights means copyright, moral rights, design rights, patents, database rights and rights of the same or similar effect or nature).

16)  Where an entry includes information or content intended to be uploaded to a website, we will take steps to moderate such content. You remain responsible for the content you provide.

17)  We will not display any content we consider to be inappropriate or for which we are not comfortable the appropriate third party consents have been granted. Our decision is final in this respect and we will not enter into any correspondence.

18)  Any entries containing content we consider inappropriate or for which we are not comfortable the appropriate third party consents have been granted will not be entered into the London 2012 Competition. We will have no liability for such entries. This means sending content which is not yours or which you do not have the owner’s permission to use will invalidate your entry.

23)  Where the prize requires attendance at a specific venue, unless otherwise stated in any Specific Conditions the winner and any permitted companions will be solely responsible for travel to and from the venue and all other expenses. We assume no responsibility and are not liable for any costs, charges or expenses which winners may be required to pay in connection with a prize.

24)  No cash alternative is available in respect of any prize.

25)  The prizes are expected to be available as set out in the Specific Conditions, however if due to unforeseen circumstances a prize is not available, we reserve the right to provide an alternative prize of at least equivalent value.

26)  The prize is personal to the winner and is not transferable to any other person, unless the Specific Conditions provide otherwise.

27)  We will notify winners of a London 2012 Competition as set out in the Specific Conditions. If we are unable to make contact with a winner within the timescale set out in the Specific Conditions, the prize will no longer be available to that person without any liability to us. The prize will be reallocated to another entrant in accordance with the rules of the relevant London 2012 Competition.

28)  We may impose reasonable restrictions on the criteria which must be met by companions of prize winners (for example relating to age or guardianship arrangements).

29)  The bodies organising the London 2012 Olympic and Paralympic Games may have specific requirements which apply to participants in London 2012 related activities. This may include, for example, the wearing of official clothing for participation in official activities such as the Paralympic Torch Relay.
