Lloyds TSB Trackside and Helicopter Promotion – Terms and Conditions

Helicopter Promotional Prize Draw - Specific Conditions- 7 February to 4 April 2012

1. These Specific Conditions apply to our London 2012 Olympic and Paralympic Games ‘Golden Entry’ Prize Draw’ (the “Prize Draw”) and apply where you have used a valid promotional code when registering for Trackside. They supplement or vary (as appropriate) the General Conditions set out below, which apply to all our London 2012 Competitions. Customers registered for Trackside will not be automatically entered into other London 2012 Competitions and must actually enter it themselves through the relevant prize draw entry page.

2. To enter this Prize Draw you must be a UK based (including the Channel Islands and Isle of Man) Lloyds TSB personal customer over the age of 18 and register for Lloyds TSB Trackside between 00:00:01 on 7 February 2012 and 23:59:59 on 4 April 2012 using a valid promotional code.

3. We are not liable if you cannot successfully register for Trackside or otherwise enter this Prize Draw.

4. There is one prize - a 30 minute helicopter ride over Olympic Park, London on 26 May 2012 for the winner and one guest (the “Prize”). No alternative date will be provided. The departure venue will be in the South East of England. Travel expenses (for example between a winner’s home and the departure venue) are not included.

5. The one winner will be the person drawn at random on or by 16 April 2012 from all eligible entries. The winner will be notified by telephone or email by 27 April 2012

6. The Prize must not be sold, donated, gifted or transferred to any other person

7. The winner’s guest must be over 7 years old on the date of the flight. Responsibility for guests who are minors remain the responsibility of the winner at all times.

8. The winner and any guest aged 16 or over will be required to provide suitable photographic identification to the flight provider prior to taking the flight. Failure to provide such documentation when requested may result in the winner and/or their guest being unable to take part in the flight.

9. Participation on the flight of anyone over 6ft 2in tall or 17 stone is subject to the flight provider’s discretion. We are not responsible for the conduct of the flight – the winner and their guest must review and abide by all terms applicable to it.

10. Lloyds Banking Group company employees, their families, agents and anyone else professionally connected with this promotion are excluded

11. Refusing to take part in any publicity or promotional activity reasonably required by us may result in the Prize being withdrawn (at our discretion)

12. This Prize Draw may be amended, suspended or withdrawn at any time.

13. We can disqualify entries.

General Conditions

1. As part of the Lloyds TSB Bank plc’s and Lloyds TSB Scotland plc’s (the “Bank”, “we”, “us” or “our”) partnership with the London 2012 Olympic and Paralympic Games, we are running a number of different prize promotions as part of our programme called “Trackside” (collectively, “London 2012 Competitions”). Trackside is designed to enable our customers to be among the first to know about our London 2012 activity and to give them the chance to win tickets to the London 2012 Olympic or Paralympic Games and to take part in the Olympic Torch Relay.

2. The following general terms and conditions (“General Conditions”) apply to all London 2012 Competitions that are promoted by the Bank or any Lloyds Banking Group company (defined in paragraph 17 below), unless specified otherwise.

3. In addition to these General Conditions, specific conditions will apply to the various London 2012 Competitions (“Specific Conditions”). Such Specific Conditions supplement and vary the following General Conditions.

Entry

4. Entry to London 2012 Competitions is open to UK based (including the Channel Islands and Isle of Man) Lloyds TSB personal customers who are over the age of 18.

5. Age limits may apply to London 2012 Competitions at the time of entering or at the time a prize is taken. By entering a London 2012 Competition you confirm that you meet the entry criteria and that, where the Specific Conditions allow entry by individuals who are under 18 and you are under 18, you have the express permission of your parent or guardian to enter the relevant London 2012 Competition.

6. Proof of age, residency and any other eligibility criteria may be requested. If you fail to provide such information to our satisfaction, we reserve the right to reject your entry and withdraw any prize.

7. Restrictions on the number of entries permitted will be set out in Specific Conditions. If there are no such restrictions stated, entries are limited to 1 per person.

8. The London 2012 Competitions are not open to employees of any company within the Lloyds Banking Group.

9. A customer can only win one pair of tickets to the London 2012 Olympic and Paralympic Games through Lloyds Banking Group ‘Trackside’ promotions throughout the duration of the Trackside programme. i.e. Previous winners of tickets will be excluded from winning ticket prizes in future London 2012 Competitions.

10. Any fraudulent, illegible, multiple or incorrectly completed entries, those that do not comply with the ‘how to enter’ instructions in the Specific Conditions and any received outside of the promotional period set out in the Specific Conditions will not be accepted.

11. Specific Conditions will set out the means by which a London 2012 Competition can be entered.

12. No purchase is necessary to enter into a London 2012 Competition.

13. Entrants may unsubscribe from Trackside at any time, although where entrants do so before a London 2012 Competition closes, we will remove the entry from the relevant London 2012 Competition.

Supplying Information to us

14. We will use the information you supply to us here and during your participation in Trackside or any London 2012 Competition to:

a. administer your entry into the Trackside programme and relevant London 2012 Competition;

b. send you information and offers around our partnership with the London 2012 Olympic and Paralympic Games;

c. verify, where relevant, that you are a customer of Lloyds TSB Bank Plc or Lloyds TSB Scotland Plc;

d. supply any prizes you win, or people nominated by you win; and

e. update contact details in our Group central records.

15. This consent only relates to London 2012 Competitions and Trackside. We will not use it to update any preferences you have already given us in respect of our other products and services

16. In order to supply prizes, we are likely to need to pass information on prize winners and any companions to official London 2012 bodies such as the International Olympic Committee and London Organising Committee of the Olympic and Paralympic Games Limited (LOCOG), their agents, and the third parties administering competitions and prizes on our behalf.

17. The Lloyds Banking Group includes us and a number of other companies using brands including Lloyds TSB, Halifax and Bank of Scotland, and their associated companies. 18. You confirm you have the appropriate permissions to send your entry to us, to use as we see fit. This means that by entering, you grant us a royalty free, non-exclusive, perpetual world-wide, sub-licensable licence to use any intellectual property rights that may exist in your entry (including any words, music, video clips, images or designs contained in an entry) for any purpose we consider appropriate. (Intellectual Property Rights means copyright, moral rights, design rights, patents, database rights and rights of the same or similar effect or nature).

19. You confirm, where an entry contains the personal details of a third party, or material in which a third party has rights, that you have the consent from such third party to provide these details and grant us a licence in the content of your entry.

20. Where an entry includes information or content intended to be uploaded to a website, we will take steps to moderate such content. You remain responsible for the content you provide.

21. We will not display any content we consider to be inappropriate or for which we are not comfortable the appropriate third party consents have been granted. Any entries with such content will not be entered into any London 2012 Competitions. Our decision is final in this respect and we will not enter into any correspondence. We will not have any liability for such entries. This means sending content which is not yours or which you do not have the owner’s permission to use will invalidate your entry.

Verifying Information

22. Where information is provided to us by children (which here means under 18s), we may need to verify details with the child’s parent or guardian, including that the parent or guardian consents to the details being provided and the child’s entry to the relevant London 2012 Competition.

23. Where information is provided to us in respect of a third party, for example the nomination of a third party for the chance to win a prize, we will verify details with that third party, including that the third party consents to being nominated.

24. Provided an entry is received before the time at which a London 2012 Competition closes, we will continue to seek such verification, and provided we can get it within a reasonable time, the entry will remain valid.

25. If we cannot get verification within a reasonable time of receiving an entry and after making reasonable efforts, we will remove the entry from the relevant London 2012 Competition. We will have no further liability for such entries.

Prizes

26. Where the prize requires attendance at a specific venue, unless otherwise stated in any Specific Conditions the winner and any permitted companions will be solely responsible for travel to and from the venue and all other expenses. We assume no responsibility and are not liable for any costs, charges or expenses which winners may be required to pay in connection with a prize.

27. No cash alternative is available in respect of any prize.

28. The prizes are expected to be available as set out in the Specific Conditions, however if due to unforeseen circumstances a prize is not available, we reserve the right to provide an alternative prize of at least equivalent value.

29. The prize is personal to the winner and is not transferable to any other person, unless the Specific Conditions provide otherwise.

30. We will notify winners of a London 2012 Competition as set out in the Specific Conditions. If we are unable to make contact with a winner within the timescale set out in the Specific Conditions, the prize will no longer be available to that person without any liability to us. The prize will be reallocated to another entrant in accordance with the rules of the relevant London 2012 Competition.

31. We may impose reasonable restrictions on the criteria which must be met by companions of prize winners (for example relating to age or guardianship arrangements).

32. The bodies organising the London 2012 Olympic and Paralympic Games may have specific terms and conditions and/or requirements which apply to participants in London 2012 related activities. This may include, for example, the wearing of official clothing for participation in official activities such as the Olympic Torch Relay. We are not responsible for those requirements or for any failure of London 2012 Competition winners to meet them.

General Provisions

33. Our decision with respect to the winners and award of prizes is final and no correspondence will be entered into.

34. Where necessary an independent adjudicator or panel will oversee any London 2012 Competition.

35. By entering into a London 2012 Competition you agree to participate in such publicity and promotional activity as reasonably required by us.

36. By entering in London 2012 Competition you are deemed to have accepted and be bound by the General Conditions and any Specific Conditions.

37. The name and county of winners will be available on the Lloyds TSB London 2012 website (www.lloydstsb.com/london2012) and if you prefer by sending a stamped, addressed envelope to Lloyds TSB Trackside, c/o MWB, 6th Floor, 88 Kingsway, London WC2B 6AA.

38. If any London 2012 Competition is not capable of running as planned as a result of any (including but not limited to) technical failure, unauthorised intervention, computer virus, mobile network failure, tampering, fraud or any other causes beyond our control which corrupts or affects the administration, security, fairness, integrity or proper conduct of the London 2012 Competition, we reserve the right to terminate, cancel, modify or suspend the relevant London 2012 Competition and / or to disqualify any person who (whether directly or indirectly) causes (or has caused) the problem.

39. We are not liable, and will not enter into any correspondence, in respect of any missed opportunity to enter a London 2012 Competition owing to any period during which the website used to upload entries is unavailable.

40. We accept no responsibility for any lost tickets or other documents related to the prize.

41. The London 2012 Competitions are governed by English law and are subject to the exclusive jurisdiction of the English courts.
